Terms of Service
The agreement between you and Bindseal for use of our licensing service, hosted license server and SDK.
These Terms of Service (the “Terms”) govern your access to and use of the Bindseal licensing and anti-tamper service, the hosted license server at api.bindseal.com, the Bindseal SDK, and related documentation (together, the “Service”). “Bindseal”, “we”, “us” and “our” mean Ayshan Huseynova, a sole proprietor registered in the Republic of Azerbaijan (VÖEN 6501887942), trading as Bindseal; “you” means the individual or organization using it. By creating an account or using the Service, you agree to these Terms.
1. The Service
Bindseal provides tooling to issue server-signed license files, bind licenses to a machine, verify them offline, and apply anti-tamper protection to software you distribute. We provide the Service “as a service”; we do not take custody of your end customers or their devices.
2. Eligibility and your account
You must be able to form a binding contract to use the Service. You are responsible for your account credentials, your admin tokens, and all activity under your account. Tell us promptly if you believe a credential has been compromised so we can help rotate it.
3. Your keys and license data
Your signing key is generated and held in a hardware security module (AWS KMS) and is never exported — not to us, not to you, not to disk. The Service requests signatures over your license payloads; it does not expose the private key. You retain all rights in your products, your public trust anchors, and your license records, and you may export them at any time.
4. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy, which forms part of these Terms. In short: don’t use Bindseal to do anything unlawful, and don’t use our protection features to brick, extort or mislead your own paying customers.
5. Fees, billing and payments
Paid plans are billed in advance on a monthly basis at the prices shown on our pricing page, unless we agree otherwise in writing. Payments are processed by Paddle, which acts as the merchant of record for your purchase. Your payment is a transaction with Paddle under Paddle’s own terms; Paddle, not Bindseal, handles card data, invoicing and applicable sales taxes, and processes refunds in line with our Refund Policy.
6. Cancellation and wind-down
Plans are month-to-month and you may cancel at any time; cancellation stops future charges and we do not provide pro-rated refunds for a partial month unless required by law or set out in our Refund Policy (which covers your first payment for 14 days). When your paid relationship ends, your already-shipped builds keep working: on request we issue a signed, perpetual release grant that winds protection down cleanly. We will never remotely disable software your customers have already paid for.
7. Intellectual property
You own your software and your data. We grant you a non-exclusive, non-transferable right to use the Service and SDK while your plan is active, and to redistribute the SDK runtime solely as embedded in your own products. We own the Service, the SDK, and our documentation, excluding your content.
8. No “piracy-proof” guarantee
We are honest about what we sell. Any protection that runs on a customer’s machine can eventually be defeated. Bindseal is designed to raise the cost and time of a crack and to let you move high-value logic server-side — it does not make piracy impossible, and we make no representation that any product protected with it is “uncrackable” or “piracy-proof.” You agree not to make such claims to your own customers on our behalf.
9. Warranties and disclaimers
We provide the Service with reasonable skill and care and will tell you plainly what each protection mode does and does not do. Except as expressly stated, the Service is provided “as is” and “as available,” and to the maximum extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits or revenue. Our total aggregate liability arising out of or relating to the Service is limited to the amounts you paid us for the Service in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
11. Availability
License verification works offline by design, so your software’s availability does not depend on ours beyond any online checks you choose to enable, which fail open within a configurable grace window. We aim to keep the hosted license server reachable but do not guarantee uninterrupted availability unless a separate service-level agreement says so.
12. Term and termination
These Terms apply while you use the Service. Either party may terminate for material breach that is not cured within 30 days of notice. We may suspend the Service immediately where required to address a security risk, unlawful use, or a violation of the Acceptable Use Policy. On termination you keep your release grant rights described in Section 6.
13. Changes
We may update the Service and these Terms. For material changes we will give reasonable notice (for example by email or an in-product notice). Changes do not apply retroactively, and continued use after a change takes effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the Republic of Azerbaijan, without regard to conflict-of-laws rules, and the courts of the Republic of Azerbaijan have exclusive jurisdiction, except where mandatory local law provides otherwise.
